OVERVIEW

The terms "we," "us," and "our" refer to Growthscale LLC, a limited liability company doing business as Koretitanium. "You" refers to the user or customer.

These Terms of Service ("Terms") govern your use of our website and your purchase of our products, including all information, tools, content, and services made available through the site.

By accessing our website or placing an order with us, you agree to be bound by these Terms, including any additional policies referenced here or available by hyperlink. These Terms apply to all users of the site, including browsers, customers, vendors, and content contributors.

Please read these Terms carefully before using the site. If you do not agree with any part of them, you may not use the site or purchase from us.

1. ELIGIBILITY AND PERMISSIBLE USE

By using our services you confirm that you are at least 18 years old, or that you are using the site with the consent and supervision of a parent or legal guardian.

You agree not to:

Use our products, services, or site for any unlawful purpose;
Violate any applicable local, state, federal, or international law (including statutory consumer rights in Canada, the United Kingdom, Australia, and New Zealand);
Transmit any malicious or harmful code;
Interfere with the security or proper functioning of the site;
Scrape, harvest, or systematically extract data from the site.

Violation of these Terms may result in immediate suspension or termination of your access to our services.

2. GENERAL CONDITIONS

We reserve the right to refuse service to anyone, for any lawful reason, at any time.

You acknowledge that:

Non-payment-related data may be transmitted unencrypted across various networks;
Payment data is encrypted during transmission using Secure Sockets Layer (SSL) technology;
You may not copy, resell, or otherwise exploit any portion of our service without our express written permission.

3. ACCURACY OF INFORMATION

We aim to provide accurate and current information, but we are not responsible for typographical errors, inaccuracies, or omissions on the site. The material is provided for general reference and should not be your sole basis for a purchasing decision.

We may update content or correct errors at any time without prior notice.

4. PRICES, PRODUCTS AND AVAILABILITY

All prices displayed on our website are shown in the applicable currency selected at checkout (e.g., USD, CAD, GBP, AUD, NZD) or converted dynamically. Applicable taxes, shipping fees, and duties are calculated and displayed clearly at checkout before payment.

Prices, product specifications, and availability are subject to change at any time without notice. We may modify or discontinue any product at any time and are not liable to you for doing so.

Some items are available online only and may be limited in quantity.

We aim to represent product colors, finishes, materials, and details as accurately as possible. However, due to individual monitor settings, the physical product may slightly vary in appearance. Minor variations inherent to the manufacturing and finishing of titanium cookware are not considered defects.

We reserve the right to limit or cancel orders, including orders placed by the same customer, credit card, or shipping address, and orders that appear fraudulent or that we cannot lawfully fulfill.

5. ORDER PROCESSING AND CANCELLATION

Orders are processed immediately after payment is confirmed to ensure fast shipping and delivery. Any complementary digital content (such as digital e-books or care guides) included with your purchase is delivered straight away via email.

Because orders are processed immediately upon confirmation, orders cannot be cancelled or amended once they have been submitted.

Please double-check your order details, product selection, contact details, and shipping address before submitting your order.

If we are unable to ship your order within 30 days of receiving it, we will notify you, and you may either consent to the delay or cancel your order for a full refund.

Nothing in this section limits your rights in respect of goods that arrive damaged, defective, or incorrect, or that do not arrive at all (See Sections 7 and 9).

6. DIGITAL CONTENT

If your purchase includes complimentary digital content (e.g., an e-book or care guide), it will be delivered to the email address provided at checkout immediately after purchase.

Digital content is non-returnable once delivered. The digital content is provided free of charge and carries no separate monetary value, so no amount will be withheld from any refund on its account.

Digital items are licensed to you for personal, non-commercial use only. You may not redistribute, resell, or publish them.

7. RETURNS, REFUNDS AND USED ITEM POLICY (STRICT)

A. Strict "Unused Product" Requirement

For hygiene, food safety, and sanitary reasons, COOKWARE THAT HAS BEEN USED, COOKED WITH, WASHED, OR ALTERED IN ANY WAY CANNOT BE RETURNED OR REFUNDED.

To be eligible for a voluntary return or refund:

The item must be 100% UNUSED, unwashed, and in pristine condition;
The item must be in its original, undamaged packaging, with all protective inserts, labels, and accessories intact.

B. Voluntary Return Request

Returns must be requested within 14 days of delivery by contacting our support team at info@koretitanium.com with your order number and the reason for return.

C. Return Shipping and Logistics

Return shipping costs for voluntary returns (change of mind) are the sole responsibility of the customer.
Our primary global fulfillment and logistics return center is located in Asia. Once your return request is reviewed and authorized, we will provide you with the correct return logistics address and instructions.
Do not send returns to our US corporate address without prior written authorization. Returns sent without an authorized RMA tracking number or sent to an unauthorized address cannot be processed or refunded.

D. Inspection and Refunds

Refunds are issued only after the returned goods have been received, inspected, and verified as unused and undamaged at our fulfillment center.

If an item is returned used, washed, damaged, or missing original packaging, the refund request will be rejected, and the item will only be shipped back to you at your expense.

Approved refunds are issued to the original payment method within 5 to 7 business days following inspection.

(This section does not limit statutory rights for goods arriving damaged or defective. See Section 9).

8. SHIPPING AND DELIVERY

Shipping destinations, delivery methods, and estimated delivery times (for Canada, United Kingdom, Australia, New Zealand, and other supported regions) are shown at checkout. Delivery dates are estimates, not guarantees.

Risk of loss passes to you upon delivery by the carrier. We are not liable for delays caused by carriers, customs clearance procedures, severe weather, or circumstances beyond our reasonable control.

Uncollected or Refused Packages: If a package is refused or uncollected by the recipient and returned to us, we will refund the purchase price less the outbound and return shipping/handling costs actually incurred.
Packages Marked as Delivered: If tracking shows your package as delivered but you have not received it, please check with household members, neighbors, or your local postal carrier. If confirmed lost by the carrier, contact us at info@koretitanium.com so we can assist.
Incorrect Addresses: Please ensure your shipping address is accurate before placing an order. If a package is returned due to an incomplete or incorrect address provided by the customer, we can reship the order once the correct address is provided and any re-shipping fee is settled, or refund the purchase price minus the actual shipping costs incurred.

9. DAMAGED, DEFECTIVE, INCORRECT OR LOST ITEMS

If your order arrives broken, structurally defective, incorrect, or is confirmed lost in transit by the carrier, we will provide a free replacement or a full refund.

Please contact us within 14 days of delivery (or expected delivery date for lost packages) at info@koretitanium.com with your order number, a brief explanation, and clear photos or videos showing the issue.

Once a full replacement or refund resolution has been completed for an issue, no further claims or compensation will be issued for that same instance.

10. DISCOUNT CODES AND PROMOTIONS

It is your responsibility to apply discount codes correctly and complete required steps during checkout (e.g., in a "Buy 1 Get 1" promotion, all eligible items must be added to the cart for the discount to apply).

Promotional discounts cannot be applied retroactively after an order is placed. Discount codes cannot be combined unless explicitly stated, have no cash value, and may be modified or withdrawn at any time.

11. BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete, and accurate billing and contact information for all purchases. You are responsible for ensuring your payment method is valid.

We reserve the right to cancel orders or restrict quantities per person, household, or order if fraudulent activity or reseller behavior is suspected.

12. INTELLECTUAL PROPERTY

All content on this website—including text, images, videos, graphics, logos, designs, product descriptions, and the Koretitanium name—is owned by or licensed to Growthscale LLC and protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, modify, distribute, or exploit any site content without our express prior written permission.

13. USER SUBMISSIONS AND REVIEWS

By submitting reviews, photos, comments, or feedback to us, you grant Growthscale LLC a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, edit, publish, and display that content across our marketing channels.

You confirm that you own the rights to any content you submit and that it does not infringe third-party rights or contain unlawful material.

14. THIRD-PARTY TOOLS AND LINKS

We may provide access to third-party tools, payment gateways, or external links. These are provided "as is" without endorsement or warranty. We are not responsible for third-party practices, policies, or content.

15. PROHIBITED USES

In addition to other restrictions set forth in these Terms, you are prohibited from using the site or its content to:

Engage in fraudulent or illegal acts;
Impersonate any individual or business entity;
Transmit viruses, spyware, or malicious code;
Collect or track personal information of others;
Bypass or interfere with site security features.

We reserve the right to terminate your access to the site for violating any prohibited uses.

16. DISCLAIMER OF WARRANTIES

Except as expressly set forth herein or mandated by non-waivable statutory consumer laws (such as consumer guarantees in Australia and New Zealand, or statutory rights in Canada and the UK), our site and products are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

We do not warrant that site functions will be uninterrupted or error-free.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Growthscale LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your purchase or use of our products or website.

Our maximum aggregate liability for any claim relating to an order shall not exceed the total amount paid by you for that specific order.

18. INDEMNIFICATION

You agree to indemnify and hold harmless Growthscale LLC and its officers, employees, and agents from any claims, demands, or damages, including reasonable legal fees, arising out of your breach of these Terms or violation of any law or third-party rights.

19. GOVERNING LAW AND JURISDICTION

These Terms are governed by and construed in accordance with the laws of the State of New Mexico, United States, without giving effect to conflict of law principles.

Statutory Consumer Notice: Nothing in these Terms excludes, restricts, or modifies any mandatory non-waivable consumer rights or guarantees granted to customers under local laws in Canada, the United Kingdom (Consumer Rights Act 2015), Australia (Australian Consumer Law - ACCC), or New Zealand (Consumer Guarantees Act 1993).

20. CHANGES TO THESE TERMS

We reserve the right to update or modify these Terms at any time. The current version will always be available on this page with the updated date. Your continued use of the website following changes constitutes acceptance of those updates.
